So yeah, we need good, long rides to rest at.

We also can't trust people not to work the system. They'll do it and the system will break as a result. Some verification is necessary.

As much as I criticize Disney, I've never once doubted their committment to guest accommodations.

This was before the official opening of Tiana's Bayou Adventure.

And I think Disney (legitimately) worried that DAS use for that ride would approach 100% of Lightning Lane capacity for the ride. Everyone else would be out of luck.

Internal documents showed DAS users were > 75% of riders on some popular rides after Disney eliminated free FASTPASS+

I don't see how any reasonable definition of disability accounts for 75% of guests on those rides.

I looked at Social Security and Census data in detail and the math didn't work.

Sorry - that was the appeal. I'll find the original ruling.

Some data from it:

- GAC users were 3.3% of guests
- They accounted for 30% of rides on (the then-popular) Toy Story Mania

Disney said DAS usage tripled from that number in the 5 years prior to 2024.

I believe them.

When Disney was sued over GAC, the pre-DAS system, Disney's expert testimony about the number of disabled users and how they specifically used DAS, went uncontested by plantiffs.

A.L. is an adult male diagnosed with autism. A.L. is in his late twenties, but his developmental age is “five-to-seven years old.” A.L.’s case is one of over forty actions filed by plaintiffs with disabilities against Disney in Florida and California federal courts, asserting that Disney failed to accommodate their requested modifications to its disability-accommodation program in violation of 42 U.S.C. Section 12182(b)(2)(A)(ii). The district court entered final judgment in favor of Disney after determining that A.L.’s requested modification to receive either ten “Re-admission Passes” for each person in his party or unlimited access to Disney’s expedited “FastPass” lines for its theme park attractions was neither necessary to accommodate A.L.’s disability nor reasonable under the Americans with Disabilities Act of 1990 (the “ADA”).   The Eleventh Circuit affirmed. The court wrote it discerned no clear error in the district court’s factual findings, no legal error in its fundamental-alteration analysis, and no abuse of discretion in its evidentiary rulings. Moreover, the district court here applied the correct legal test. It considered whether the requested modification would affect merely peripheral aspects of Disney’s parks or aspects essential to Disney’s services. The court further found that the other reasons A.L. offers for the presentation of the excluded evidence are neither relevant nor probative of the individualized injunctive relief he sought.

The concern I have with the pre-2024 DAS system is that it created financial incentives for people lie about disabilities.

I'm convinced enough people lied that it hurt everyone in the park, including guests who truly need accommodation (and everyone else in line).

You make a good point about the loss of 45-minute wait/20-minute sit-down-ride attractions. I think it's a combination of shorter attention spans and the need to get more people through the ride per hour (which is a function of needing more capacity).
