A fair point. I have to wonder, though, if they know what they're doing, do they think they can win? Or are they just planning to put on a show for Trump, and engage in a lot of performative nonsense in their filings that the judge will ignore but the press will salivate over?
lizardky.bsky.social
And it never has been. The press in the US has *always* been lying, biased, and partisan. Thomas Jefferson and Alexander Hamilton both founded newspapers to slander the other. Hearst instigated the Spanish-American War to sell papers. Countless other examples.
lizardky.bsky.social
People believe there are laws against "lying" in the general case (there are narrow, specific cases where it's illegal, but they don't apply here), or that there exists in the US a "news license", or a "journalism license", or that there are laws about "fake news", and that's just not true.
lizardky.bsky.social
The same rules as apply to any media. As Dominion showed, they can get hit w/defamation. But that's a civil suit (not criminal) and rare to win -- this was an exception (they settled because their email made it clear they knew they were lying). "Pretending to interview antifa" isn't defamation.

Reposting to correct typo.
What does that have to do with *anything*?

FNC is a cable channel. The FCC has no authority over it.
There is no such thing as an "entertainment" channel or "news" channel. Broadcast stations are not licensed for a type of content; cable channels are not licensed at all.
lizardky.bsky.social
The "Fox classified as entertainment by FCC!" lie began well before Trump took office. It dates to an article on a humor site in 2013 -- which you'd know if you'd bothered to read the links I provided.

So you just repeat a lie, even when shown facts proving otherwise.

Do you work for Trump?

Waiting for the same people who think only Christians should be allowed to vote to start telling Catholic Bishops to "stick to praying and keep out of politics".

/6 I know that people think lawyers are pedants but there is a reason to have rules and policies and procedures. And you have to take them seriously. A SEXUALLY EXPLICIT CARRICATURE OF ANDY NGO DOES NOT BELONG IN THE BYLAWS. NO NOT EVEN IN THE APPENDIX.

It kind of surprises me, because I’d think you need the same kind of mindset — highly logical, to learn and juggle a mountain of small rules, understand their interactions, and find existing code (precedent) to build on. But they do seem very bad at it.

I can’t tell you how many times I, a total non-lawyer, have corrected someone on specific things they’ve gotten wrong on law, such as the legal meaning of “broadcast” or ”indecency” and been told “details don’t matter!”. When discussing *law*. A field where hairs are split with monomolecular blades.

“Real” is not the same as “competent” or “ethical”.

I’ll give 1-in-10 odds one of them drops out when they see in detail what a pile of shit they’ve been handed. Odds are low because all the most ethical have already left or been fired.

No, they’re not. Please stop spreading disinformation. Thank you.

It’s legal for me to claim to have a Congressional Medal of Honor. It’s legal for some rando to claim they’re “antifa”.

Given all the abuses the Trump admin is committing using a small number of limited powers over media, it astounds me anyone thinks the answer is “give them more power!”
lizardky.bsky.social
It violates no laws, past or present. There have never been “truth in journalism“ laws, in any media. No, the Fairness Doctrine had nothing to do with truth.

A civil suit for defamation? Who is being defamed? Anitfa doesn’t exist. It can’t sue.

The White House Antifa Roundtable is one of the best displays I’ve seen of this-is-how-bad-it’s-gotten — just a sewer of open fascism, dementia, morons and freaks, and incoherent rage.

/3 Here, by the way, is what the Supreme Court ACTUALLY said about Trump’s theory in Texas v. Johnson 36 years ago:

Amusingly, the current story arc of the Lower Decks comic is about the fact that a single pair of humpbacks isn't exactly a breeding population, so the Cerritos has to come back and get some more. (You'd think the biologist they picked up would've mentioned that...)

No, just Leland Yee AFAIK. I have a special hate-on for him due to his anti-video game bills, so, even though he's long out of power, I will take every opportunity to mock him.
