Seems to but IANAL. Private institutes in all states especially the other 28 plus PR and DC could sue too. (Like get COGR to do it).

Continuing resolutions have extended that part of law. The first CR for FY25 PL 118–8, in section 101 says they are using all the same clauses as before. Then the December CR did basically the same (some minor changes including to HHS but not to NIH).
