"That question meant one thing when we had presidents who, for whatever reason, were constrained to acknowledge reality. It means something else altogether in an administration for which, to borrow from George Orwell, 2 + 2 = 5."

Well, I'm just as afraid of Vladek's other point: "In other words, the issue is going to come down to who decides the facts when it comes to domestic use of the military."

From the article: "During the Biden administration, there were 26 deaths in 48 months—roughly one death every two months. During Trump’s term, that rate has nearly quadrupled."

Not to put too fine a point on it, but unprecedented numbers of immigrants are dying under the second Trump administration. www.thebulwark.com/p/the-moral-...

No TRO today in the second Illinois case, either, but Judge Ellis has found the plaintiffs challenging ICE protest enforcement actions have standing for TRO purposes and are likely to succeed on First and Fourth Amendment claims. They also went through the proposed TRO in depth. Follow up coming —>
chrisgeidner.bsky.social
"At this point, DHS is on notice," Ellis says, but she says she would rather give a couple days for DOJ to get "real answers," particularly as to the identification issue, from clients.

A follow-up hearing will be at 2:00 p.m. CT Wednesday.

Parties are also asked to confer in the interim.

No TRO yet, but this judge is 🔥

"It cannot be the case that DHS officers are given carte blanche" to respond to protests with whatever force they deem necessary, Ellis says.

Ellis says that based on available evidence, it's possible that plaintiffs could show 1A and 4A violations by DHS.

HAPPENING NOW — This morning, Mayor Brandon Johnson signed an executive order establishing “ICE-free zones.”

“That means that city property and unwilling private businesses will no longer serve as grounds for these raids,” Johnson said to applause.

NEW: Mayor Brandon Johnson signed an executive order prohibiting federal immigration agents from using any City-owned property in enforcement activity.

MAYOR BRANDON JOHNSON SIGNS “ICE FREE ZONE” EXECUTIVE ORDER, PROHIBITING USE OF CITY PROPERTY FOR FEDERAL IMMIGRATION OPERATIONS

The directive expands Mayor Johnson’s Protecting Chicago initiative, inviting community partners to participate in the work of safeguarding
the inalienable rights of every Chicagoan.

CHICAGO – Today, Mayor Brandon Johnson signed the “ICE Free Zone” executive order, which creates clear mechanisms to prohibit
federal immigration agents from using any City-owned property in their ongoing operations in Chicago. The order expands upon Mayor Johnson’s
Protecting Chicago initiative, inviting local businesses and community organizations to join the citywide effort to safeguard our communities, while advancing measures to rein in the reckless behavior of federal immigration agents.

“We will not tolerate ICE agents violating our residents’ constitutional rights nor will we allow the federal government to disregard
our local authority. ICE agents are detaining elected officials, tear-gassing protestors, children, and Chicago police officers, and abusing Chicago residents. We will not stand for that in our city,” said
Mayor Brandon Johnson. “With this Executive Order, Chicago stands firm in protecting the Constitutional rights of our residents and immigrant communities and upholding our democracy.”

Mayor Johnson’s most recent
Protecting Chicago executive order comes following documented use of Chicago Public Schools parking lots and a City-owned parking lot at Harrison and Kedzie as staging sites for federal immigration enforcement operations, a violation of Chicago’s Welcoming
City Ordinance. The use of City resources for these actions erodes trust between immigrant communities and the City, weakening the relationships that are essential to ensuring community safety and constitutional policing.

Under Mayor Johnon’s leadership, the City is taking swift and decisive action to prevent these transgressions …

Late-night legal L from Trump, as judge he appointed isn’t buying the administration’s attempt to get around her previous ruling by directing out-of-state Guard units to Oregon.

What impact could this have on the new plan to send Texas Guard units to Illinois?
jonseidel.bsky.social
Meanwhile, out west, U.S. District Judge Karin Immergut is entering a new temporary restraining order “that prohibits the relocation, federalization or deployment of any National Guard under [President Donald Trump’s] command, Title 10 status, within the State of Oregon.”

From @govpritzker.illinois.gov:

“President Trump is ordering 400 members of the Texas National Guard for deployments to Illinois, Oregon, and other locations within the United States.”

IL state troopers are already pushing non-violent demonstrators out of the street and away from the ICE facility. One arrest so far.

I don't know if there was an alert. There should have been. I spent 2.5 hours helping direct traffic at Pershing and Kedzie. OEMC was nowhere. CPD did nothing to address traffic control.

I spoke to a Venezuelan woman who was arrested in this raid and later released with her 4yo son. She said agents broke down their door, pointed guns at them and made sexualized remarks about Venezuelan women. When she returned to her apartment it was boarded up and all her possessions were gone.
