The courts are fully aware trump is planning to attack Venezuela. They have plenty of time to issue a ruling on the constitutionality of such an action.

The way to ascertain whether an order is legal or not is to have it go through the courts 1st, before the military action is carried out. The problem with deciding afterwards is that you potentially have a bunch of murderers running around with no accountability.

If you want to know whether or not 'servicmembers' will follow orders, look through the past 10 years. As far as constitionality, it would have to be debated and would be too late for the people who have died because of 'orders'.
