In other words: they want it to be binding, but not 'precedent' in the way that term is usually meant, which is another indication that they don't see themselves as legitimate in the way they once were.

They're saying it as chastisement but they're also not spelling out what their shadow docket judgments mean or how they should be applied. They're saying 'We will chastise you if you don't figure out what we meant here, but we won't say it because we will change course if a Dem becomes President.'

That's my point: they won't outright say 'this is precedent,' instead they say 'we need you to get with the program and do what we're doing without us having to spell it out,' which is a sign they don't see what they've been doing as legitimate, or in keeping with the history of the Court.

I honestly don't think they see themselves as legitimate in that sense, anymore; if they did they wouldn't feel the need to use the shadow docket and implication to avoid setting down precedent, or get so mad at the lower courts for refusing to play along.

My (admittedly limited) understanding was that it was a way to resolve an internal conflict by forcing the hand of various factions within Hamas to commit to liberation over administration, which both allowed Hamas to 'win' and almost certainly made it less able to rule in 'peacetime.'
