Given the massive opposition from commenters, do you think there is a possibility for a court to find proceeding with the rule would be arbitrary and capricious under the APA? I cannot recall an NPRM receiving this volume of negative response, let alone one in which the agency adopted the rule.

It’s kind of a lazy choice. Bovino has no shortage (no pun intended) of character traits that deserve insults.

It would be awesome for me personally if I took every case to trial. Alas, it is rarely in my clients’ interest to do so, so I am routinely advising them contrary to my self interest.

If you are going to be a fiduciary—whether to a client or to an electorate—the gig is to put self-interest aside.

Haven’t experienced hallucinations. What Lexis AI will give you is 3-5 cases that are almost entirely irrelevant to what you’re looking for. Avoid.

From my experience in practice, Lexis AI is hot garbage. Virtually useless. Westlaw’s AI tool is pretty good, but some use cases work better than others.

Regardless, you need to read the cases and rely primarily on traditional research methods.

“Abolish” sounds extreme, and Moderates by definition are not extreme.

With that said, there is a growing acceptance by many in the political center that “abolish ICE” is the moderate position.
