I once saw him speak at GW law school, and he told a story about being called into the Oval when they were discussing Just Cause. And someone (may have been Bush) asked him if Posse Comitatus prevented use of the military, and he said absolutely not, it’s no barrier whatsoever.

Also, it is very unusual for the government to prefer one production rather than rolling productions in these kind of investigations. And defense counsel would typically want to make them to create a record of cooperation—“to date we’ve produced X hundred thousand pages of documents,” etc.
