You know how restaurants ask if you have any allergies instead of relying on you to know the ingredients in a given dish? The restaurant staff know the conditions inside the restaurant. Not saying anything because it's not legally your responsibility is simply a shitty thing to do.

Well generally if you're in the role of the restaurant you should inform people of this when they don't seem to be aware.

Cross-contamination is still dangerous to people with Celiac's. You're right it's not immediate, but it builds up serious long-term damage over time. If they are requesting a gluten-free fryer, they probably do need it and just don't realize that the air is also full of gluten.
