BREAKING: Federal judge BLOCKS a new ICE policy that went into effect last week to automatically detain unaccompanied migrant children on their 18th birthday when they “age out” of shelter care.

ORDER GRANTING MOTION FOR TEMPORARY RESTRAINING ORDER AND TO ENFORCE FINAL JUDGMENT AND PERMANENT INJUNCTION
Upon consideration of Plaintiffs' Motion for a Temporary Restraining Order and to
Enforce the Permanent Injunction and accompanying Memorandum of Points and Authorities
and Declarations (the "Motion"), and all other materials properly before this Court, it is hereby
ORDERED that Plaintiffs' Motion is GRANTED; and it is further
ORDERED that Defendants and all persons acting under their direction or in concert with them, are hereby ENJOINED from implementing any new directive regarding age-outs;
ORDERED that Defendants and all persons acting under their direction or in concert
with them, are hereby ENJOINED from detaining any class member in an adult ICE facility in
any manner that contravenes the Permanent Injunction;
ORDERED that Defendants immediately rescind any determinations to detain based on this directive;
ORDERED that Defendants immediately produce that directive, any related policies
regarding that directive, and the Age-Out Review Worksheets of any class members who may
have been impacted by that directive, including all AORs issued since October 1, 2025.

Judge Patti Saris, during a hearing in Boston, told a DOJ lawyer she would not put on hold a class action challenging the denial of bond hearings for detained migrants, saying even if the courts run out of cash, she was working. "Who knows how long this shutdown will be, right?" she said.

I suspect the timing is a coincidence and the real factor on timing, for him and all the judges flooding the courts with rulings today on long-standing motions, is today is a deadline for the rule to avoid being deemed a slow in the judiciary's Civil Justice Reform Act reports.

MEMORANDUM OPINION AND ORDER
Before the Court are Defendants' Motion to Dismiss Intervenor-States' Amended Complaint ('Defendants' Motion) (ECF No. 218), filed January 18, 2025, and Intervenor-Defendant Danco Laboratories, LLC's Motion to Dismiss Intervenor-States' Amended Complaint ("Danco's Motion) (ECF No. 221), filed January 28, 2025 (together, the "Motions"). The Court granted Intervenor Plaintifis leave to file a consolidated response to the Motions. BCF Nos. 226, 227. Intervenor Plaintiffs responded to the Motions on February 20, 2025. ECF No. 228. Defendants and Danco replied on May 5, 2025, after the Court granted a deadline extension. ECF Nos. 247, 248, 241. On August 22, 2025, Texas and Florida also moved to intervene. ECF No. 254. Louisiana followed suit on September 19, 2025. ECF No. 264.
The Motions are now ripe. Having considered the Motions, briefing, and relevant law, the Court GRANTS Defendants' Motion and DENIES as MOOT Danco's Motion. The Court also DENIES as MOOT Texas, Florida, and Louisiana's Motions to Intervene. This case is TRANSFERRED to the Eastern District of Missouri under 28 U.S.C. Section 1406(a).
