I agree but would also posit that contrarian news also seems to gain traction easily too. That's how all those "good thing us actually bad" and vice versa stuff gets traction. Like people just seem to believe something is more honest if it goes against the perceived narrative.

They should just do Noah and Mio as a double character like Ice Climbers that you can switch between. They said they wanted to do that with Pyra and Rex but couldn't due to system limitations, but with the Switch 2 Noah and Mio would be a great duo character imo.

I think it depends. If you take it down to like a Geek Squad they can maybe do it for free by just plugging it in to another device and partitioning it or something. But I know some drives can break in a way that costs like upwards of $500 to retrieve from.

Overall though, the law is stupid and makes it difficult to punish companies for things like this, hence why it keeps happening.

A potential punishment could have a lawyer who intentionally drafts illegal terms in a contract could face disbarment, but that takes probably years of litigation and is probably hard to prove.

There's no punishments otherwise to my knowledge though because that would punish individuals and small businesses that just don't know better. Again though, not a lawyer.

This isn't legal advice but I think it technically is. In contract law if a section is considered illegal or voided it can potentially invalidate the whole contract depending on how it's drafted. You'd have to talk to a lawyer though.

There's a trend in some tech companies where they would put illegal terms in contracts because the guys in charge didn't know it was illegal and thought they were geniuses not realizing that the reason no one else did it was because it was illegal. Machinima back in the day did something like this.

There's a good chance it is illegal, but companies will put things like that in there expecting no one to try, and even if they do they just drag on litigation to make it expensive. From what I understand you can't ever actually sign away a right to sue, but I'm not a lawyer.

I feel like a lot of indie nominees every year are like this. Functionally it seems like they nominate games made by studios that just aren't subsidiaries of larger companies, but even then they've gotten that wrong.

Does it have a dedicated GPU? Sometimes games and things will run off of the motherboards internal one rather than the dedicated one.

Yeah I can see that. I've always taken it as them having such a pedigree for quality and innovation people are more likely to notice and criticize the faults, which snowballs into people thinking it's okay to make threats.

Tbh it's not just a Nintendo thing. I've seen a lot of mention of devs from tons of studios getting threatened over the years.
