The moral component is primarily liberal, ie, Kantian, Lockean, in nature, such that people are treated as individuals with dignity whose rights cannot be trespassed without justification. Treating law as merely rules of a game to be enforced neutrally (John Roberts) misses the entire fucking point.

It means that people spend too much time looking backwards. The assumption in every war is that it will be just like the last war. It’s why militaries ends up being unprepared to fight a new war. It’s a poor assumption for 2028 when Trump will be excluded or dead and Harris won’t be our candidate.

But maybe swing state dems are just more likely to vote? Maybe we can always expect voters who hear our messages to be responsive to them? It feels like a basic truism—you gotta give people the counter arguments or they’ll believe what they’re told.

Practically speaking, assume they rule against Trump, would you rather have the district court’s opinion or an opinion written by this Chief Justice? Why? In short, it’s either overruled or it’s fucked. I can always be wrong but don’t get your hopes up.

Yes, because there is no need. They don’t weigh in on all substantive issues. Taking cases to satisfy their ego when there is no legal reason for doing so demonstrates the corruption of the court. Country of laws, not men, and all that crap.
