That's not true, though. Cobb was elected in 1936. Stump's nonsense wasn't published until a quarter-century later. Contrary to Stump's lies, Cobb was respected and well-liked by his peers, and contemporary reports bear that out. He was known for being a hard nosed player, but not a dirty one.

The thing is, Perry didn't do anything wrong. The nuns tried to sell property that didn't belong to them while the legal owner (the Diocese of LA) was negotiating the sale to Perry. Worse yet, the nuns would have gotten ripped off had their sale been perfected.

I'll offer the unpopular theory that there was *something* sufficient to give defendant notice that the Government intended to charge him. I realize I'm conflating language from case law for superseding indictment with new, etc.

I have a vague recollection that the applicable statute allows filing of a new indictment so long as the dismissal occurred after the statutory period and for any reason other than it being untimely.
