In 2006, a flag-burning constitutional amendment had already passed the House with two-thirds but failed in the Senate by one vote. It likely would have been ratified by the states; as those numbers show Dems were far from united against it.

Beside the point, but Texas v. Johnson is one of those “hold on, it was *that* close?” 5–4 cases where the dissents age like limburger. John Paul Stevens dissented!

Rehnquist’s principal dissent says flag burning is an “inarticulate grunt or roar” that convey no expressiveness “but to antagonize”

While I kind of agree the supermajority hurdles are a bit too high, this is the counter-example that always comes to mind when people say all our problems are because Article V makes constitutional amendments too hard. We'd have a flag burning amendment. We'd probably have a marriage ban one, too.

Again, focusing on individuals staying or going misses the point.

What does become a real problem is when the issue gets framed (usually by more gentry expats or those who follow them) as "everyone who stays is doomed."

That is false and it is genuinely, unacceptably damaging.
