She could have been the most qualified, but she wasn't weighed and measured against all 791, only the 54. This is, and will forever be a fundamental flaw with DEI. The onus is on you to prove she was the best when measured against all, not me. It's a big task, get busy. 👍

Under pressure, Biden made a campaign promise to nominate a black woman when a vacancy occurred. There were 791 active federal judges available for consideration after Breyer resigned. Of those, 54 were black women. Would she have been chosen on the basis of merit alone? We'll never know.

No evidence that she has benefitted from DEI, she's certainly a vocal opponent of it. The argument has been made that her advancement typically male dominated field of prosecution is a result of her gender, but that seems to be opinion. Did you find any evidence?
