Yeah, I am not feeling particularly confident about this challenge. It’s effectively asking Strasbourg to overrule the English courts when it comes to allowing third party interventions in administrative cases.

I feared this would be the response. I am concerned that the court will reject this application because of standing rules in judicial review. I think it would be better if the money and support when to a challenge brought by Stonewall or a trans applicant.

On a bad day, this kind of commentary does not help. Explanatory Notes aren’t legal authority—they reflect the government of the day’s interpretation of the legislation. Courts don’t use them when interpreting statute, they rarely even cite Hansard.
