If I were asked to advise my command on this, I'd leave the legal aspects up to JAG, but I would point out that rules of engagement help preserve the foundations for future peace, are essential to good order and discipline, and reduce the risk of moral injury, which in turn produces resiliency.

The Hague and Geneva codes are rooted in the Lieber Code, itself the result of hard-learned lessons about the brutality of war and the necessity to place some limits on combat.

It's not much - even the modern Geneva Conventions are overly-vague and ill-enforced. But it's a start.

The law of armed conflict and contemporary rules of engagement trace their origins back not to Genevea or the Hague but to the Lieber Code, an order issued to the Union Army in 1863.

Yet another example of how memorializing traitors isn't the same thing as remembering history.
