HB289 could mean lawyers, not doctors, will be consulted if a pregnant patient needs health care, including in an emergency. This bill could jeopardize IVF, chemotherapy, and abortion access if the partner, abuser, or even rapist of a pregnant patient is able to sue.

HB 289 would create a slippery slope that could lead to fertilized eggs and embryos having the same rights as a living person. That means for a pregnant patient, lawyers, not doctors, will be consulted if they need health care, including in an emergency. #flleg

HB 289 could jeopardize IVF, chemotherapy, and abortion access if the partner, abuser, or even rapist of a pregnant patient is able to sue for the loss or termination of the pregnancy.

"There are a lot of issues with this bill, but I think the primary concern for me personally is that the cause of action does not lie with the consent of the mother." - Devon, @atheists.org #SB164 #flleg

"I have friends who recently became first-time mothers. While they are overjoyed to be parents, they are no longer sure of having a second child in this state... The prospect of not being able to access the care if they need a miscarriage or an abortion is terrifying. - Madeline, public speaker

"Are we sure that our current law is as clear as can be as to when the life of the mother is in jeopardy and a doctor has to make a decision that the law in Florida is so clear that every doctor and every hospital knows that they are protecting this woman lawfully? - Sen Polsky

"Isn't a business or another person or a friend going to be subject to incredible cost and turmoil over having to defend a case just to have a judge finally rule it out, because this is such an open-ended, vague legislation that you're proposing?" - Sen Polsky regarding SB 164
November 4, 2025 at 6:44 PM
Berman- If somebody orders abortion pills and they come in the mail, and they give them to their friend, could the father in that case bring a lawsuit against the friends and family?

Grall- If they procure something illegally and they give a drug illegally to somebody, that could be a wrongful act.
November 4, 2025 at 6:41 PM
The current back-and-forth between Sen. Berman and Sen. Grall highlights an issue with many culture war bills like SB 164. Supporters are either unaware or indifferent to the real harm caused by their legislation.
