This is why there is the weird stuff about how like the "steamboat willie" version of mickey mouse is public domain but the later style of him is not. Which means that, as far as IP law is concerned those are different guys, even though the author intended them to be the same.

Its also worth noting that "Characters" specifically don't have copyrights attached, but using the characters is usually considered an infringement on the copyright of the book or movie or whatever the character comes from.

A lot of songs don't have any copyrights. for example "House of the rising sun." The recording of it made famous in the 60s by The Animals, is copyrighted, but the song itself isn't. "House of the Rising Sun" still exists, is not, and at least under current US Law cannot be intellectual property.

No, those are 3 different kinds of works which may, depending on a few things about them have copyrights attached.

"Intellectual property" is a catch all term for the laws around patents, copyrights and trademarks. All of which are state issued temporary monopolies on the reproduction of certain kinds of works in certain contexts. The works and contexts have changed a lot over time.

OK if this conversation started with "in the future when we all have flying machines and teleporters we should turn the roads into gardens" and someone said "no we will still need roads" and when asked why they said "so we can travel efficiently" I would be curious what they thought a road was.

Yeah but you have also said you think the modern system of intellectual property should be replaced. I dont think the term itself can really be specifically understood outside that system so Im still pretty lost here.

Relax, I'm not trying to "beat" you here im trying to understand why you seem so attached to the term intellectual property. The problem is you keep moving from really broad sweeping vague claims and questions then running back to narrow things that seem like normal concerns about credit and such.

I mean under modern IP regimes often they cant! Prince famously had a problem with that in the 90s.

But like if you aren't really married to "intellectual property" as a conceptual/legal framework as much as you are concerned about general protection of creative pieces and credit, I think we are on the same page and just splitting hairs about details, so thanks for answering my questions.
