If you are a normal person, it's easy to say that Trump could be criminally prosecuted for using the military to kill his political opponents. If you are a Trump judicial nominee, the calculus is apparently more complicated.
For Trump’s Latest Judicial Nominees, Trump Is a Law Unto Himself
Can presidents be criminally prosecuted for using the military to kill their political opponents? Trump's nominees keep having a hard time with this question!

I know Rob Drake is the better known MAGA MLB umpire, what with his “CIVAL WAR” tweet when Trump was impeached, but Dan Bellino, the crew chief in the NYY / TOR series, looks cut from the same cloth, at least based on his X followers

What is this, some sort of Paul Blart spin off?

She may very well have voted for it, but it's a decent sign that Judge Haynes joined the panel majority. Haynes, Southwick, and Richman often end up voting together en banc, but every case is different!
profjpc.bsky.social
Richman's vote wasn't necessary to go en banc, because Senior Circuit Judge James Dennis, a member of the original panel, can't participate in the vote but *can* participate in the rehearing (I believe).

Judges who'll vote to reverse (9): Elrod, Jones, Smith, Willett, Ho, Duncan, Engelhard, Oldham, & Wilson

Judges who'll vote to affirm (8): Stewart, Southwick, Haynes, Graves, Higginson, Douglas, Ramirez, & Dennis

Swing (1): Richman

I missed this yesterday, but the Fifth Circuit agreed to rehear en banc the panel decision (Ramirez, Haynes, and Dennis, J.J.) affirming a district court's holding that Louisiana's requirement that schools display the Ten Commandments is unconstitutional.

Durbin: "What's happening in Illinois is outrageous. To think they're going to federalize the Texas National Guard and send them into my state is not only necessary, it's almost criminal."

Virginia Republican gubernatorial nominee Winsome Earle-Sears has no policy positions, has shared no plans for what she’d do if elected, grants no interviews, and isn’t even on her own campaign bus as it tours the state. She’s a candidate in name only.
Spanberger answers questions about policy. Earle-Sears does not.
This fits a pattern where Earle-Sears has avoided taking about most issues. Her silence on issues is unprecedented in modern Virginia history.

On Thursday, the Senate Judiciary Committee will vote out the last of Trump's judicial nominees (except John Guard, whose nomination is stalled because of his potential involvement in some Medicare scam). Realistically, there's probably only time for one more group of nominees to get through.

Claremont hack is redundant
maxkennerly.bsky.social
Despite appearances, this is not a @nytpitchbot.bsky.social joke, it's an actual @nytimes.com column by some Claremont hack who praises Hegseth for his "nuanced vision of the military’s purpose and its relationship to civilian society."

This bio is so MAGA-coded you’d think Grok wrote it. Alas!
Mr. Gaiser clerked for Justice Samuel A. Alito, Jr. of the Supreme Court of the United States, Judge Neomi Rao of the United States Court of Appeals for the D.C. Circuit, and Judge Edith H. Jones of the United States Court of Appeals for the Fifth Circuit.
In the private sector, Mr. Gaiser worked at the law firms Jones Day, Boyden Gray, and Gibson Dunn.
He graduated from the University of Chicago Law School and Hillsdale College. He is also a husbare and father.

Mascott jumping the line here is unsurprising given that she’s the most MAGA-aligned of the three pending circuit court nominees and she can cement a MAGA majority on the Third Circuit (and right before it hears a major gun case).
