It is wonderful to see members of both parties in the Senate having difficult conversations and finding a path to compromise in order to finally end the government shut down. The biggest threat to our nation stems from the lack of such conversations.

I urge all Americans to advocate for restoration of funding for the Corporation for Public Broadcasting. It is a great American institution that can be improved but that we cannot afford to lose.

Today the United States Court of Appeals for the D.C. Circuit denied rehearing in the Marin Audubon case. Thus, the panel decision that CEQ’s NEPA regulations are unlawful will stand. The Trump Administration is moving to rescind those regulations as I previously noted.

On December 9, the Council on Environmental Quality sent all federal agencies guidance on implementing NEPA in light of the Marin Audubon decision. The guidance is likely to be short-lived.

The Montana Supreme Court affirmed a lower court decision that the state’s Constitution provides its residents with the right to a clean environment and that the state was violating this right by permitting fossil fuel projects without considering the impacts on climate change of such projects.
