There are postwar examples of folks who turned down the job—Thomas Dewey & John Foster Dulles before Warren was nominated; Howard Baker during the Nixon admin (acc. to John Dean). Was certainly more prominent in the 19th c, though—when many nominations were also rejected.

I agree it’s disingenuous for Barrett to suggest she would have turned it down. BUT quite a few people turned down nominations to SCOTUS in the past (including several already confirmed by the Senate). Says a lot about how much the position has changed in terms of prestige & desirability.

I debated writing this. It can feel tempting, upon encountering yet another instance of this administration’s racism, to let it be. How many ways can you say the same thing over and over again? And yet we have to write it down, if for nothing else, so those who come after us know we were against it.
