Reason is not a legal journal. It's a conservative publication and that's an opinion piece.

What matters is that a grand jury comprised of ordinary citizens found probable cause to indict Trump. What matters is that a jury of his peers found him guilty of 37 felony counts.

I've seen a couple right-wing lawyers refer to it as a novel legal theory. That doesn't make it so. The law is clear that falsifying business records in pursuit of another crime — in this case, a conspiracy to subvert an election — is a felony.

This SCOTUS might have ruled it as protected speech, but that would be overturning clear precedent (inciting imminent lawless action). I can’t think of a more textbook example of UNPROTECTED speech.
