Now, if he wasn't a Martian, then they would accept the case but then still dismiss it as frivolous and a waste of the court's time.

In any case, there is now legal precedent in Ontario, Canada, that Martians cannot initiate lawsuits. /end

A "person" is legally defined as a human being, or a corporation. Since they were required to assume the plaintiff was a Martian, they said he didn't qualify as a "person" under the law to sue the Canadian government. /5

At the Appeals Court level, the Justice in the trial decided to dismiss the case due to lack of standing. You see, in order to commence a legal action in Ontario, you had to be a "person". /4

The government tried to have the case summarily dismissed as frivolous. But at the time if there were disputes about the facts of the case (like being a Martian), the plaintiffs "facts" were assumed to be true. This is no longer the case. /3
