House dems should use their rules to cause as much pain as possible if the Senate won't step up: object to unanimous consent/force record votes, vote down special rules, collect signatures for discharge petitions and bring bipartisan bills to the floor. Be a pain in the ass and draw attention

This would be a crime under 5 U.S.C. 552a (i) (2) and (probably) creates a civil cause of action for federal employees impacted under 5 U.S.C. 552a (g)(1)(C) or (D). Not an attorney but I think any federal employee could now sue DOGE

How do you counter this? When you tell someone he wants to do x or he plans to do y they just say "nuh uh he's just saying that" and if someone is going to seal off their world view from reality, is there any way to bring them back?

He's mostly breaking administrative/civil law so enforcement would probably fall to the Inspectors General for the agencies or the DOJ. General public and states don't have standing bc the "victim" here is the federal govt. Because he's within EOP they might try to argue presidential immunity

Is there anything stopping them from calling for roll calls on every procedural vote/motions, and forcing quorum calls? Won't do much to stop legislation but at least makes the process painful

If the market is going to fund wave after wave of meme stocks and hype around dead-end technologies, let's at least use this as an opportunity to bankroll the scale-up of the last major puzzle pieces to a carbon free grid.

With either strategy, the outcomes are the same, you would own the libs, but you would also kill tens of thousands of jobs. Without knowing the appointees at DOT and Treasury, it is impossible to know if partisanship or policymaking will be the greater motivation.

Another issue: most of the awards/grant programs in the BIL rely on DOT/DOE contracting with states/awardees. If you fire everyone, then the money is stuck until agreements can be executed. If the incoming admin decides to burn everything to the ground, they could freeze billions overnight.

I'm not an expert in rulemaking, but it looks like this would take several months of ping ponging btwn OMB and DOT/Treasury. This would be bad, but at least the industry would have some time to plan, make public comments, and lawyer-up.

Without going too deep into the weeds, the implementation of NEVI and IRA credits relies on rulemaking, and the admin could decide to change/revoke the rules currently in place, killing both progs

Even if they were to give under direct pressure from Trump, there are 1,000 ways they could slow roll the bill long enough for him to move on (à la ACA repeal)

In congress, everything indicates that the House doesn't have the votes to kill either IRA credits or NEVI— an amendment to H.R. 4820 to defund NEVI was voted down with 27 R Nays in Nov 2023, and 18 Rs signed a letter in August of this year telling the speaker to not fuck with the IRA.
