the version of events provided in the article makes it clear that the failures were by the NHS, and the only difference right to choose made is that he would have died waiting for an NHS assessment instead

The issue is that the NHS doesn't have the capacity to deal with any mental health issues, because they (and successive governments, and you) do not take them seriously.

If the NHS had 10% of the oncologists it needed, would we be seeing these articles about people seeking private cancer treatment?

I've experienced both and the NHS one was significantly worse, e.g. not collecting any information from family for a condition which is diagnosed based on your childhood.

Absolutely disgusted by the state of mental healthcare in this country, and stigmatisation of people trying to cope with it.

Yes, and my point is that I obviously want the government to act in a moral fashion (e.g. not imposing inhumane conditions of imprisonment on people trying to coerce them into no longer aiding and abetting genocide), and that I don't think hiding behind "legality" makes them any less evil.
