Yep. Let’s suppose he had sex with a 17-year-old. And let’s say there’s a witness who said he told Gaetz the girl was in high school. But say another witness says she was saying she was in college. And everyone was stoned.
Reasonable doubt on mens rea? Sure.
Should Gaetz be AG? No way.

I've seen the argument that if DOJ didn't charge file charges against Gaetz, the allegations against him must be weak, but this doesn't necessarily follow. DOJ's authority to prosecute sex crimes is limited. As general matter, statutory rape, etc. are not a federal offenses.
