It’s not a matter of whether we’re fine with it. It’s a matter of whether it’s legal. It may be, but the courts will almost certainly be called upon to decide.

There could be some equal protection issues with this. It isn’t as easy to justify such distinctions as you might think. Particularly if it goes up through the federal courts on Constitutional grounds.
