Because infrastructure funds jobs in red states. So red state politicians went along with it. Everything they didn’t got overturned by Trump’s SCOTUS.

This is the system we currently have. Meanwhile, citizens are passing referenda and state constitutional amendments to protect rights.
There is no excuse for allowing genocide. But we had more of a chance to stop it.

I absolutely think it should be legal. But the filibuster exists, and it had to be a part of the planning. If we can’t get the law to pass the Senate, it can’t make it to the desk of POTUS to sign it.
