The Prosecutor is now appealing parts of the El Hishri warrant, arguing the Chamber wrongly excluded charges tied to victims of African descent—saying they weren’t detained “for conflict-related reasons” or part of the targeted civilian population. www.icc-cpi.int/sites/defaul...

Unlike in Elmasry, Judge Flores Liera did not dissent in El Hishri—likely because of Libya’s declaration. The warrant confirms this shift: it refers to Libya’s recognition of ICC jurisdiction under Article 12(3). www.icc-cpi.int/sites/defaul...

We saw the effects right away. On 10 July 2025, the ICC issued a sealed arrest warrant for Khaled El Hishri, accused of crimes at Mitiga Prison. He was arrested in Germany just days later, on 16 July. www.ecchr.eu/en/press-rel...

The declaration not only accepts jurisdiction—it explicitly asks the ICC Prosecutor to investigate crimes linked to detention, disappearances, torture, trafficking, and persecution. A 2-year extension of ICC investigations is also requested.

That jurisdictional concern, initially raised by Flores Liera, now seems moot. On 8 Aug 2025, Libya’s declaration under Article 12(3) was made public: it accepts ICC jurisdiction over crimes from 2011–2027. www.icc-cpi.int/sites/defaul...

Moreover, during parliamentary debates, Italy's Minister of Justice cited Judge Flores Liera’s dissent—arguing the ICC lacked jurisdiction—as justification. But interestingly, Italy didn’t repeat that argument in its formal May 2025 submission to the ICC. www.icc-cpi.int/sites/defaul...

In Jan 2025, Osama Elmasry was arrested in Italy under a sealed ICC warrant. Days later, Italy released him and flew him back to Libya. According to Italy, the original warrant had errors,—corrected only 5 days later and there was a competing extradition request. www.aljazeera.com/news/2025/1/...
