We've had similar issues with the MonoGame project. But we've continued to keep everything, we can, free. I think from IP perpective OSS need to evolve and somehow incorporate a way to sign code (I know that sounds wierd), so it can be attributed back to 1 person/group. Then it's traceable.

I bet someone will last 24 hours in the 1st week. You could offer an prize to the person who last the longest after a month. This will get more people to try to play the game. Also bragging rights.
Maybe also add a treadmill, to the game, so that they have to incorporate exercise too.

Love this modern take on tamagochis. What I'd suggest is integrate Steam or similar, have a leaderboard and once the game is released, periodically post who's the leader.
