Why must "kinds of beings that could be granted or denied rights" have "lived embodied experience"? Animals are in. Disembodied AI is out. The paper takes as a given some philosophy that is hardly universal (phenomenology from Merleau-Ponty and Husserl), but doesn't provide a justification for this.

To be more clear: I didn't expect that the any account of US courts in the 21st century ("the law") would provide ample support for the most nihilistic critical legal realism.
