Located at Howard University School of Law, the 14th Amendment Center on Law and Democracy is a multi-disciplinary institute dedicated to exploring the transformative impact of the 14th Amendment on American democracy.
The Supreme Court’s decision to hear a challenge to birthright citizenship is a direct test of one of the 14th Amendment’s core guarantees. Section 1 is unambiguous and it has been for more than 150 years. Birthright citizenship is not a policy. Not a preference. Not a debate.It’s the Constitution.

At @VisionandJustice NOW, @EJI founder Bryan Stevenson explained how 15 years ago he came to understand that civil rights litigation would not be enough. “We couldn’t win Brown v Board of Education today.” Stevenson created the @legacysites.eji.org in Montgomery, spurred by this realization.

The theory that now that the challenges to Trump’s birthright citizenship EO will proceed as class actions they will make their way quickly to the SCOTUS & be decided forthwith (Justice Kavanaugh’s claim) is, in my view, not likely. I explain why on @andersoncooper360.bsky.social.

The Ku Klux Klan Acts (passed in 1870 & 1871 to protect 14th amend rights) were particularly focused on masked gunmen who violated the civil rights of Black people. We should remember this history when masked law enforcement ofcrs are deployed in our communities.
