In law school we studied the principles underlying the decisions, but never the motivation. I suppose it all goes back to Jackson, “He has made his decision, now let’s see him enforce it.” It always appeared that SCOTUS had to balance the risk of simply being ignored.

We need 3, 4, or even 5 political parties to restore political balance and accountability to the electorate. Particularly following the ruling in “Citizens United” the two parties are just two sides of the same coin. Flip it and you still get the coin.

The Constitution is actually the framework of checks & balances intended to enable the govt to protect against the excess of the executive. The first ten amendments are intended to protect the people from the excess of govt. It ALL relies on the good faith of those elected to office.
