I believed them too when I was in law school! Believed (in my Spring 2002 ConLaw class) that Bush v Gore was an outlier and not a skeleton key. I was slowly, systematically and viciously proven wrong.

The idea that Alito is going to give a sympathetic audience to the good faith argument because his former clerk is making it is as dumb as the idea that only about fifty people in the country are qualified to argue before this court.

It’s nice, at least, that the majority and concurrences noted how improper Jerry Smith’s dissent was and that conspiratorial ranting about a well known (((bogeyman))) have no place in our jurisprudence.
