100%. Today's ruling highlights as clearly as ever that the US Supreme Court -packed/coopted during Trump's 1st term- is at war w/ the lower federal courts. The lower courts are trying to defend rights & the rule of law, but the Supreme Court is enabling executive aggrandizement & trampling rights

The S Court just struck a major blow against democracy and the rule of law, stripping lower courts of the long standing power of “universal injunctions,” the ability to stop administrative illegal action in its tracks. The timing couldn’t worse given the authoritarian threat that is Trump.

We've been working on this since 2023, when Civic Coalition won the Polish elections & a wave of democratic optimism swept Brussels. We knew that feeling was premature. The EU/Polish case teaches broader lessons about the promises & challenges of restoring liberal democracy. Please share & comment!

In Europe, the promises/perils of frontsliding are clear in Poland. A pro-democracy gov't won an election in '23, but struggled to break up autocratic enclaves. Our restorative disobedience argument charts a path for the Polish gov't & the EU (one the EU has already strayed from, to its detriment)

Building on @tomginsburg.bsky.social & Huq, we theorize "democratic frontsliding" as a subtype of democratization. The obstacles to frontsliding are "autocratic enclaves" surviving a democratizing election. We make the normative & legal case for "restorative disobedience" to break up these enclaves
