Did you see the video at www.instagram.com/p/DTOA4tWlCIL/ ? Pay close attention to time stamp 3:08 to 3:09 where the first shot is fired. Looking from this angle it appears the ICE agent fired the first shot before the car was past him and was actually leaning IN rather than OUT trying to avoid.
