My org @immcouncil.org represents those two gay men. They had been arrested on charges of sodomy by Iranian moral police, and fled the country seeking asylum. They face the death penalty if returned, yet the Trump admin denied their asylum claims in a kangaroo court process.

They are terrified.

I geeeeeeeet it ... BUT ........ the only thing here is that the OBBBA funds question was literally laid out in her Dec order because it had come up, so this isn't so much about the form as it is the different legal question between "ignoring 527" and "claiming that OBBBA is not subject to 527."

No, this is a bad idea, because it would lead to them being able to argue that they lack the capacity to handle all of the visits on the given timelines — particularly if there are multiple no-shows.

Noem is attempting to run around statutory language requiring oversight visitation (Sec. 527) by using OBBBA funds and claiming the admin can restrict access b/c those funds are not appropriations subject to Sec. 527.

To the extent courts buy this loophole argument, Congress must close it.

I get that the plaintiffs pushed back, but this was where it seemed like Cobb was at the hearing last week.

I would expect a new challenge or amended complaint or some similar action in short order.
