The other side is if we're executing people of Palestinian nationality, we run into the problem that under Israeli law, Palestine has no statehood therefore no nationality. So the presumption is we can execute people with no nationality. Still seems safe enough.

I wonder if it applies to the Palestinian nationality or the Palestinian ethnicity.

On one hand, it may be difficult to determine a secular Israeli Palestinian from a secular Israeli Jew. If I was Israeli under such a scheme, I'd be a little worried that I'd accidentally fail the brown paper bag...

It will be an interesting legal development.

In theory the executed person may for the first time actually be permitted to be present at, and have legal representation in the new a priori process.

Of course, that's only where existing court national security ex-partite provisions don't apply.

There's always been executions of Palestinians. This just adds an option to apply the judicial approval a priori instead of ex post facto.
