No? The argument is that the judge needs to look at individuals to identify violations rather than assuming violations and the government has shown a high probability of irreparable harm if they try and do that after letting everyone go. A stay for appeal to SCOTUS is separate and common.

Okay, but you're not thinking about the risk of rich people having access to better medical care than poor people. Like Mark Cuban points out, that would be a grave injustice. The only way to keep healthcare available to everyone is to prevent everyone from obtaining healthcare.

It is a tough question in that I would really prefer not to have the administrative state destroyed in one fell swoop. But, I would also prefer not to have the complete power of the administrative state concentrated in Trump's hands. Maybe that those are the choices should tell the Court something.

One of the many things that is so crazy about these explanations is that this was the first strike. How would the sailors have any idea what hit them? No one even knew Trump had declared "war" on them, but they were trying to stay "in the fight"? What a disorienting and terrifying moment to live in.

I know too many lawyer jokes to believe people ever really respected lawyers as a whole in my lifetime.

But, that's also part of my point. They are the kind of lawyer who operates in the gray space between the rules. With less gray space, such behavior is better contained.

That is indeed what he will argue. This is not my practice area so I cannot speak to how successful he will be. I know the govt may still reindict post-SOL if first indictment was returned by a null grand jury which seems analogous to me, but there may be more specific relevant case law out there.
