The last group fail to understand the only reason we're having this conversation is gay hate got too politically unpopular, and that was redirected onto a palatable target. If the fight weren't over minors and sports it'd be over "catfishing" etc. No concessions. Not one step back.

He can't operate the entire federal government on his own. If Congress won't impeach, maybe the proper remedy is enforcement against the lower federal bodies or even individuals who are not complying with court orders.

I'm a little confused about the wording here: "The Court finds it likely that Plaintiffs will succeed on the merits in showing that Section 4 of the Medical Services EO violates the Fifth Amendment’s Equal Protection Clause."

I thought Equal Protection was a 14th thing? What am I missing?

This is great. I'm not a lawyer but this filing seems to be arguing exactly what I'd expect: "they
are forced to 'out' themselves ..., imposing wrongful barriers" - I think one would be hard pressed to argue the policy is narrowly tailored, with these knock on effects.

I'm not a lawyer (constitutional or otherwise), but is it not pretty settled that Equal Protection is broken when some are more equal than others? Just because everyone is subject to the same written reqs doesn't mean it's allowed. The same defense was raised against gay and interracial marriage.

I wonder if we'll see a lawsuit over the passports soon. In my view it's a clear breach of the Equal Protection clause: everyone else's passports reflect their daily appearance, as is the purpose of an identifying document. (1/2)
