It is frighteningly Orwellian to see these power zealots commandeer a term - “viewpoint diversity - that originated as a substantive LIMIT on government power to enter the speech domain at all. And this isn’t government speech or public forums; it’s new and brazen.

Related, I've never understood how / why most originalists just ignore the 9th Amendment. That's like a student taking an exam saying, "yeah, that one is too hard - I'll just leave it blank." If it's because it's vague, that itself is a sign the framers were infusing the con with non-originalism.

Two things:

1. The anti-DEI movement is intended to make people question the legitimacy of any Black person they see in a skill position. A factory reset to White as the default setting for merit.

2. Trump’s team is the most unqualified in history. So merit obviously isn’t the real intent.

Had the letter actually specified rules around classroom instruction, could that be challenged on First Amendment grounds? Since this traces to an actual funding threat, I can’t imagine that would be mere government speech, right?

Trump’s team explicitly leaving out the Fed here is actually just a form of projection. He is actually signaling / saying that he intends to include it at some point.

I remember when you wrote about Bush's "Justice Department's Eight" or whatever you called them. Another earlier example of this Unitary Executive dynamic. Now Trump is running rampant with it.

I remember when some of W's signing statements implied an Executive Branch right to ignore court orders. Do you think they were the seeds for Trump's extreme actions? Or was the W stuff a different kind of thing? Seems like it all might be one spectrum on the Right.

IMO, this is a way to come over the top of everything and go on full offense. Pushing press clips everywhere, including X.
