When Custom Binds All States 🌍⚖️

MARKUS GEHRING (@mwgehring.bsky.social) on the International Court of Justice's trailblazing findings on customary international law as it applies to climate change.

Quote: “The ICJ clarifies that rejecting or breaking the existing international treaty regime on climate change does not diminish any State’s obligations to actually address the underlying global challenge that is climate change.”

Please remember this story behind the AO next time someone tells you that things cannot be changed. What a fantastic and historic win.

Did you notice how several of the ICJ erga omnes arguments today were similar but taken one step further by the IACtHR? As Judge Tladi highlighted, perhaps considering them jus cogens would have made good sense? Also because they used art. 48 ARSIWA commonly associated with jus cogens violations.
verfassungsblog.de
Among the major surprises of the IACtHR's Advisory Opinion on the climate emergency are its reflections on jus cogens and the climate crisis. 🌍⚖️

@mwgehring.bsky.social explains why this part of the ruling matters so much and what the legal consequences are.

Quote: This is the first time that an international court has explicitly recognised the jus cogens character of the obligation not to create irreversible damage to the climate and the global environment.
zunaida-mw.bsky.social
Absolutely! It’s long past time international law recognized that today’s choices shape tomorrow’s world. Intergenerational equity isn’t just a moral imperative; it’s a legal one too. A crucial step toward sustainable and responsible governance 💪

Such an important Declaration by ICJ Judge Tladi: While declaring the erga omnes character of the climate obligation, it should have perhaps expressed an opinion on the jus cogens character. Powerful declaration.

MY REFLECTIONS: The @CIJ_ICJ advisory opinion marks a profound legal affirmation that climate obligations are not aspirational, they are mandatory. Yet, my relief is tempered by concern: will States heed this mandate or treat it as another well-worded academic text with no teeth.
