Sehr lesenswerter Thread, warum die mit Stimmen der Rechtsextremen, aber eben leider auch Linken und Grünen beschlossene Überweisung des Mercosur-Abkomnens an den Europäischen Gerichtshof eine Katastrophe ist. Dass die Grünen das noch als Sieg feiern, macht mich ratlos. Ich hielt sie für klüger.
was ist eigentlich ein eugh gutachten und warum sind heute so viele so genervt davon, dass das eu-parlament entschieden hat zum mercosur abkommen den eugh zu fragen? mal wieder ein kleiner jura-thread. nach art. 218 abs. 11 aeuv können alle wesentlichen akteure eu abkommen vom eugh auf seine vereinbarkeit mit eu-recht überprüfen lassen. solche gutachten prüfen alle bestandteile eines abkommens auf deren vereinbarkeit mit europäischem primärrecht. matthias fuchs @matthiasfuchs 8 Std. dabei werden die unterschiedlichsten fragen geklärt. kompetenzen, die gewichtung einzelner bestandteile, abgrenzungsfragen, ratifizierung. und und und. und sowas dauert. eines der bedeutendsten gutachten zu freihandelsabkommen ist das gutachten 2/15. 1 9 1,3K matthias fuchs @matthiasfuchs 8 Std. ich habe wirtschaftsvölkerrecht im schwerpunkt studiert und meine abschlussarbeit über das singapur gutachten des eugh, eben das 2/15, geschrieben. das gutachten zu dem freihandelsabkommen zwischen der eu und singapur hat ca. zwei jahre in anspruch genommen. 1 10 1K 88 matthias fuchs @matthiasfuchs 8 Std. die kommission hat das gutachten im juli 2015 in auftrag gegeben und der eugh hat es im mai 2017 erstattet. aber nicht nur das, er hat das EUSFTA, um das es damals ging, zu einem gemischten abkommen erklärt und die ratifizierung des abkommens damit massiv erschwert. 1 11 1K matthias fuchs @matthiasfuchs 8 Std. denn gemischte abkommen sind solche, die nicht nur in der kompetenz der eu selbst liegen, sondern auch in der der mitgliedsstaaten. und von denen müssen sie nach deren nationalstaatlichen regeln zusätzlich ratifiziert werden. und sowas dauert. matthias fuchs @matthiasfuchs 8 Std. im ergebnis: ja, man kann sich so rechtssicherheit holen. aber das dicke ende steht eben auch in art. 218 abs. 11 aeuv: hält der eugh das abkommen für teilweise vertragswidrig, dann muss es vor inkraftsetzung verändert, also nachverhandelt werden. und das dauert. 1 17 10 1969 matthias fuchs @matthiasfuchs 8 Std. zwar können über art. 218 abs. 5 aeuv abkommen auch vorläufig angewandt werden, das war in der vergangenheit aber nicht die praxis der eu, dort hat man den ausgang von gutachtenverfahren in der regel abgewartet. und für investoren ist "vorläufig anwendbar" auch kein schmankerl. 2 16 l 1,2K matthias fuchs @matthiasfuchs 8 Std. und zu guter letzt: keiner sagt, dass der eugh dieses mal nur knapp unter zwei jahre braucht. und was er dieses mal bemängelt. 2 17 Stefan 18 1,1K @StefanAltmyr - 8 Std.
