Egregiously inaccurate is right. I mean even aliens detained as enemy combatants at the United States Naval Station at Guantanamo Bay, Cuba have access to the U.S. courts!

But they can be indefinitely incarcerated pending removal proceedings. There doesn’t seem to be a constraint as to WHERE this detention occurs. And the Boumediene holding found that Habeas applied not due to legal control over the detainee but control over the place of detention.

Well, SCOTUS notes in Boumediene that we have “de facto sovereignty” over Guantanamo in a way that we don’t over foreign military bases. Not sure if that changes the ICE authority analysis.

The judge will have to decide. The government's motion includes some... not very good lawyering (see below).

The DOJ makes two arguments. First, they say he knowingly made a frivolous argument. Second, they say he had an "improper purpose" to delay removal, an argument I *am* concerned about.

I wonder how long until the Hamdi and Boumediene decisions, limited as they are in practice, are outright gutted. And I wonder how long before "internment camps were good actually" becomes the mainstream opinion again.
