These rights were crystalized for Albertans in 1995 when the Freedom of Information and Protection of Privacy Act (FOIP Act or Act) was prodi force. This Act requires all public bodies in the province, including government public bodies, la information available to the public subject to the limited and specific exceptions to this right as set out in the Act. Investigation Report Summary On August 16, 2023, I launched a systemic investigation into the Government of Alberta public bodies' (GoA PBs) compliance with sections 7(2), 10(1), and 10(2) of the Freedom of Information and Protection of Privacy Act (FOIP Act). The investigation was launched in response to a series of requests for reviews (RFRs) of access requests refused by GoA PBs citing section 7, and, access requests refused citing section 10(2), including those made by the Globe and Mail (TGAM) as described in its Secret Canada articles. My investigation found that GoA PBs are not permitted by section 7 to refuse access requests. In doing so, I also found that GoA PBs contravened their respective duties to assist under section 10(1), including when they: • Required applicants to limit the number of topics in an access request to one. • Placed limitations on the timeframe of the search for records. • Required applicants to split requests containing multiple topics into multiple requests. • Required applicants to structure requests in a manner that enables them to be completed and responded to within 30 days. With respect to section 10(2), my investigation found that GoA PBs are not permitted by section 10(2) to refuse to create records in response to access requests except as permitted by that section and that GoA PBs' current practices with respect to section 10(2) do not comply with the FOIP Act. A series of recommendations were provided to remedy the non-compliance found in the investigation. I recommended that the GoA PBs cease the practice of refusing access requests under section 7(2) and to adhere to the scheme of the FOIP Act by assisting applicants to meet the requirements under section 7(2) as required by section 10(1). Further, I recommended that the GoA PBs cease the practice of refusing to create a record under section 10(2) in accordance with its current practices and, instead, follow the scheme of the FOIP Act by providing an explanation to applica…
