the modern world itself is world-historically weird. and its basis lies far deeper than changes to antidiscrimination law in the 1970s. we are in the midst of a great change: embrace it.

1) Imani is correct

2) separately, FEDERAL antidiscrimination ENFORCEMENT is on pause for another three years. Important to keep in mind that the justice department expressly saying "we're not enforcing disparate impact anymore" does not change the law. Private civil suits are still available
hard to overstate how bad this is for discrimination against everyone but white people.

I'm saying we are undergoing a wholesale revision of equal protection and anti-discrimination law so that it only protects white people.

Let me explain:
This makes facially neutral policies--like poll taxes and literacy tests--that we know were adopted for discriminatory purposes legal. Organizations can now simply claim there was no discriminatory intent regardless of outcome. It's unconstrained institutionalized racism.

On today of all days @theguardian.com could practice some subtle antidiscrimination, and not put this story on its front page. It's not particularly important news, and just a glance at the name and headline will feed some nasty antisemitic tropes among those so inclined.

Northwestern University law profs argue that NU's "deal" with the Trump admin violates the First Amendment and federal antidiscrimination law.

Moreover, the grant freeze Trump imposed on NU was unlawful and should have been challenged in court.

I'm not surprised. Slightly more than half of the US supports limited antidiscrimination trans policies. It's why the 'they/them' campaign ads by Trump were effective. We have lots of work to do before all are treated with respect. For today, I just pray the chemo continues to work for Ms. Capasso.

In that latter event, the remedy is just to go to the court of claims and say "hey, they stopped paying on this grant for no reason at all," and then they either say "we did it because of antidiscrimination law," getting back in the statute, or they admit to having no reason and an injunction issues
November 29, 2025 at 3:13 AM
That actually means Northwestern had an even better case: the statute governing termination of grants for alleged violations of antidiscrimination laws (42 U.S. Code § 2000d-1) requires notice be given; the government‘s clear violation of that procedural requirement makes the case easy
