Carol Mitchell's apartment. Nicole challenges in two ways Carol's reimbursement for the apartment she moved into after the break-in. First, Nicole challenges whether Carol's decision to move into the apartment is compensable at all under § 611A.045, subd. 3. In short, Nicole does not believe Carol's choice to move into a new apartment is a "loss sustained ... as a result of the offense" and thus the costs related to moving and living in the apartment are not an "appropriatel]" ... type of restitution."' Therefore, because Nicole does not believe the cost of Carol's apartment is reimbursable, she disputes Carol's claim of $21,267.50, and instead believes the proper amount is $0.00. Next, even if Carol's decision to move into the apartment is compensable under § 611A.045, subd. 3, Nicole still believes Carol's requested reimbursement amount is too high. First, the $535.00 deposit should have been refunded to Carol upon vacating the apartment, so that should not be a loss attributable to Nicole. Second, Carol should have lived in an apartment only until sufficient protections could be installed in her home, so there's no justification for Carol living in the apartment for 12.5 months. Assuming that such protections could be installed in 3 months, Nicole should only be obligated for that time period, making the other 9.5 months —some $15,751-not reimbursable. Third, there is no reason Carol should have rented a two-bedroom instead of a one-bedroom apartment. So again, even assuming it was proper to move into an apartment, and that it was proper to live there for 12.5 months instead of 3 months, the reimbursement amount requested is still too high because the amount should be cut to what a one-bedroom should cost, not a two-bedroom. Simply put, Carol is one person, so she needs one bedroom, not two. On a 12.5-month lease, that's a savings of between $4,980-6,480 that should be reduced from Nicole's restitution owed. 4. Carol's egress window. Nicole makes one challenge to the proposed reimbursement related to Carol's egress window. As shown at trial, Nicole only damaged the screen on the outside of the egress window. The egress window itself was old, rotted, and had been long damaged itself. Nicole therefore should not be required to replace the entire egress window unit when her conduct did not cause any damage, let alone enough to justify a full replacement. At most, Nicole should pay for a replacement of the screen she pried open in order to enter Carol's home. On the high side, a new screen would be $100.00 with parts and labor, so Nicole believes the proposed restitution amount of $946.89 for the egress window is too high by $846.89 and that Nicole should owe only $100.00 to replace the screen she broke during her entry into Carol's home. Challenge 3: Carol's laptop. While there is no dollar amount on the restitution request form, Nicole still wishes to specifically challenge any claim of reimbursement for a computer or laptop of any kind. First, unrefuted testimony established that the laptop was given to Nicole by Carol long before the break-in. Second, the laptop was given back to Carol after the break-in, even though she had previously discarded it, so she never actually "lost" anything. And third, the laptop was objectively old and not functional, so there is no reasonable replacement value to it. For all these reasons, Nicole believes the amount she should owe Carol for the laptop is $0.00. In sum, Nicole believes the following restitution is appropriate here: a. Apartment unjustified: • Replace egress window - $100.00 • Replace locks on house - $121.58 • Security system on house - $2,559.06 • Moving costs - $1,423.00 • Total = $4,203.64 b. I've found that the UVtoolkit's pack UV function to be more stable compared to add-ons like UV magic.
The latter is fine for low poly models but completely freezes when dealing with subD models with a relatively
high polycount.

ADUs can be restricted from High or Very High Fire Hazard Severity Zones. And the city has restricted ADUs from lots that are both a) in a VHFSZ and b) front a street <20’W in a Hillside Area, as defined by the Hillside Area Map.

Can local agencies restrict ADUs based on Fire Hazard Severity Zones or other environmental hazards? HCD understands that extreme weather conditions occur, and the threat of destructive wildfires cannot be ignored. Some agencies have used the High (HFHS) and Very High Fire Hazard Severity Zone (VHFHSZ) maps provided by CAL FIRE to mark areas where ADUs may be restricted or prohibited altogether. However, according to CAL FIRE, the HFHSZ and VHFHSZ maps are intended to govern building materials used in construction and defining zones of defensibility around structures. These are not intended to restrict housing development. The presence of a High Fire Hazard Severity Zone is not a conclusive rationale to warrant restricting ADUs. A restriction based on the threat to public safety should be supported with findings detailing the impact of ADUs on public safety. (Gov. Code, § 66314, subd. (a).)

I have a hard time focusing on things when there's too much stuff going on, and tbh I'm very bad at polygon modelling or subd modelling. I learned hand drafting and metrology before CAD and it's always felt far more inline with how I approach design thought naturally. I've been using Rhino since v3.

In this case, the landlord failed to comply with the requirements of Minn. Stat. § 504B.161, subd. 1(a)(5) to provide "heat at a minimum temperature of 68 degrees Fahrenheit in all places intended for habitation" during the cold season.
In regard to habitability, Relators argued that Respondent Landlord had failed to provide adequate heat in Mr. Bush’s apartment, and likely the apartments of numerous other tenants. (Id.). To support this argument, Relators submitted a complaint that Mr. Bush had sent to the Department via certified-mail. (Id. at 92-93). The Department, in addition to managing the rent-stabilization program, is also the City entity responsible for residential building inspections. SPLC §§ 34.07, .19. In the complaint, Mr. Bush explained that his apartment was unable to maintain, or even achieve, the legally-required 68-degree temperature, and, although he had repeatedly requested that Respondent Landlord fix the issue, the problem persisted. (Doc. 12 at 92-93). Included with the complaint was picture evidence of multiple thermometers showing that Mr. Bush’s apartment had reached the required 68-degree temperature only once in the span of seven days, despite the thermostat being set to 72 degrees. (Id. at 96-160).

So, why is Alpha News bringing a 2nd appeal alleging error "where the district court failed to consider that the relevant criminal trial had already occurred and resulted in a verdict months before"? My guess": bc the MGDPA allows a prevailing party to be awarded attorney's fees from the other side
5. List specific issues proposed to be raised on appeal. (1) Was it error for the district court to deny the release of data pursuant to Minn. Was that error? (3) Did the District Court err by denying Petitioner’s motion to authorize the disclosure of data related to the arrest of former Senator Mitchell? Subd. 4.Action to compel compliance. (a) Actions to compel compliance may be brought either under this subdivision or section 13.085. For actions under this subdivision, in addition to the remedies provided in subdivisions 1 to 3 or any other law, any aggrieved person seeking to enforce the person's rights under this chapter or obtain access to data may bring an action in district court to compel compliance with this chapter and may recover costs and disbursements, including reasonable attorney's fees, as determined by the court. If the court determines that an action brought under this subdivision is frivolous and without merit and a basis in fact, it may award reasonable costs and attorney fees to the responsible authority. If the court issues an order to compel compliance under this subdivision, the court may impose a civil penalty of up to $1,000 against the government entity. This penalty is payable to the state general fund and is in addition to damages under subdivision 1. The matter shall be heard as soon as possible. In an action involving a request for government data under section 13.03 or 13.04, the court may inspect in camera the government data in dispute, but shall conduct its hearing in public and in a manner that protects the security of data classified as not public. If the court issues an order to compel compliance under this subdivision, the court shall forward a copy of the order to the commissioner of administration.

Notably, Mitchell's criminal trial is an entirely separate case with an entirely separate judge. Then, in September, the trial court in the Alpha News MGDPA case issued its reconsidered ruling *based on the original motion,* as it seems like was ordered by the Court of Appeals.
In reaching this decision, we decline Alpha News’s request to review the record under the correct legal standard and to direct the district court to order the data’s release to the public. The statute tasks the district court with conducting the balancing test in accordance with the law. Minn. Stat. § 13.82, subd. 7. We take no position on the strength of the asserted public benefit, on whether the benefits of release outweigh the identified harms when considered under the appropriate standard, or on whether the circumstances of this case ultimately call for release of the data. Those determinations fall squarely within the district court’s discretion.

It's been a quiet few weeks on the Court of Appeals docket, but I want to share with you an excerpt of a decision released today. I am not good at criminal law, but I think it's safe to say that you should not say you intend to "slit a bitch's throat" during your probation violation hearing.
FACTS Respondent State of Minnesota charged appellant Crystal Lynn Senart with making threats of violence under Minn. Stat. § 609.713, subd. 1 (2022), for a statement she made during a contested probation-revocation hearing conducted over Zoom. Senart pleaded not guilty, and a two-day bench trial was held. At trial, the district court considered the transcript of the probation-violation hearing. During that hearing, Senart admitted to several probation violations. The district court then asked the probation agent (the agent) to recommend a consequence for the violations, and the following occurred. THE AGENT: Your Honor, this is a 364-day file. I have twenty-six days calculated. I would be okay with ninety and discharge. I’m not sure what the State is recommending. THE COURT: Okay. Thank you. SENART: Ninety mother f-ck--g days, dude?
