Nearby, Pamela Hemphill sat smoking a cigarette in a blue lawn chair. The 72-year-old, once known as “MAGA Granny,” said she wanted to see what the “war-ravaged” city President Trump described actually looked like.

“They aren’t violent,” Hemphill said of the protesters she’s interacted with. “They’re some of the sweetest people.”

Hemphill is one of the 1,500 people who received a presidential pardon for storming the U.S. Capitol on Jan. 6, 2021. She turned down the president’s clemency offer, telling news outlets across the country that she regretted her participation that day.

She told The Oregonian/OregonLive she wants to help dispel misinformation about what’s happening in cities like Portland after Trump’s orders to deploy the National Guard. She arrived on Sunday, traveling from her home in Idaho with her dog.

“It’s my way to atone,” she said.

The complete statutory definition of “banner” is “a long, rectangular, or square piece of fabric,
paper, or other material, often displayed in a vertical or horizontal manner, used to convey a
message, symbol, emblem, or representation of an institution or a political, religious, or
ideological expression, or used to announce or celebrate an event or achievement.”
Based on these definitions, a banner can include something elongated like an oval-shaped paper
or something which is larger than usual regardless of its shape. Because the legislature did not
identify a minimum size of a “banner,” when considering what is “larger than usual,” a court
would consider what is a standard size paper/material in the circumstances. In the public school
setting it is reasonable to consider any material larger than a standard piece of paper (8.5’x11”)
as “long”. (NOTE – another option is material larger than children’s construction paper (9x12)
since this is a standard size of children’s artwork hung on elementary school walls).
Your question does not address the term “long” contained in the definition. As “long” is
separated from “rectangular” by a comma, it does not describe the rectangle.1
Instead, it
separately describes the banner material and must be considered or applied separately from
rectangular and square. This means a banner is not limited to just a rectangular or square shaped
item; it also includes a “long” item. As “long” is not defined in the statute, we must look to the
plain meaning, i.e., the dictionary definition of the term. See e.g. Mattson v. Idaho Department of
Health and Welfare, 172 Idaho 66, 76 (2023) (internal citations omitted). Merriam-Webster
provides the following relevant definitions:

● “having greater length than usual”
● “having greater height than usual”
● “having a greater length than breadth; elongated”
