A big reason it takes the form of anti immigration is that gives it plausible deniability because it allows them to say "we are only targeting people who don't follow the rules and do not assimilate" as opposed to overt racism where that part is said out loud.

Immigration opposition in its contemporary form in America is racist because it is aiming to suppress potential nonwhite population growth.

It also often assumes that the white immigrants are too culturally different as well or are not significant enough in numbers to care about.

As to the second, Judge Perry examines what “unable” means, what it means to “execute the law,” and what the reference to “regular forces” means.

She concludes that it requires a situation where civil law has broken down and the military is unable to handle the situation.
